These Terms and Conditions ("Terms") govern your access to and use of the website skylinedigital.marketing (the "Site") and any services provided by Skyline Digital Marketing LLC ("Skyline Digital," "we," "us," or "our"). Skyline Digital provides digital marketing services including, but not limited to, search engine optimization (SEO), pay-per-click advertising (PPC), website design and development, social media marketing, content creation, email and SMS marketing, and related consulting services.

We also provide free tools on our Site, including an SEO website scanner. Use of these tools is subject to these Terms and any additional terms presented at the time of use.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, local, or international law
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
• Use any automated means (bots, scrapers, crawlers) to access the Site or its content without our prior written consent
• Attempt to interfere with the proper functioning of the Site, including introducing viruses or other malicious code
• Impersonate or misrepresent your affiliation with any person or entity
• Use the Site to transmit unsolicited or unauthorized advertising, spam, or promotional materials
• Abuse, overload, or exploit our free tools (e.g., the SEO scanner) in a manner that degrades performance for other users

3. Free SEO Scanner Tool

Our free SEO website scanner is provided "as is" for informational purposes only. Results generated by the scanner:

• Are based on automated analysis at a single point in time
• May not capture all aspects of your website's SEO performance
• Should not be considered a comprehensive SEO audit
• Are subject to rate limits (per IP address) to ensure fair usage

By using the scanner, you represent that you have the authority to scan the website URL you submit. We reserve the right to restrict access to the scanner at any time.

4. Client Portal (MY SKYLINE)

If you are a client with access to our portal, you are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account.

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, icons, designs, code, and software, is the property of Skyline Digital Marketing LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the Site without our prior written consent, except for personal, non-commercial use.

The Skyline Digital name, logo, and all related marks are trademarks of Skyline Digital Marketing LLC. You may not use them without our prior written permission.

6. Client Work and Deliverables

For clients who engage our services under a separate service agreement:

• Ownership of deliverables will be governed by the terms of your individual service agreement
• Unless otherwise stated in your agreement, we retain the right to showcase completed work in our portfolio (with your company name and general project description)
• We may use anonymized, aggregated data from client campaigns for marketing and case study purposes

In the event of conflict between these Terms and your individual service agreement, the service agreement shall prevail.

7. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Skyline Digital. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party links at your own risk.

8. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Site will be uninterrupted, secure, or error-free
• Results obtained from the Site or our tools will be accurate or reliable
• Any defects will be corrected

Digital marketing results vary. We do not guarantee specific outcomes, rankings, traffic levels, or revenue increases. Past results are not indicative of future performance.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SKYLINE DIGITAL MARKETING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Skyline Digital Marketing LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Charleston County, South Carolina.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
